What's a litigator? Well, a lot of things, but, today, I want to talk about what I do that is more consultative: reviewing contracts, negotiating exits, and analyzing potential claims before any lawsuit is filed.

Waiting until a dispute arises to have a lawyer review a contract is a bit like waiting for your car to break down to read the owner's manual. Although I would recommend having a litigator review contracts before you sign them, another option is to bring in a litigator to review contracts as soon as you feel the relationship going sideways. We all know that feeling--deep in our gut--that something is off here.

When that happens with your contractual relationships, I can help. Maybe circumstances changed and the deal no longer makes sense. Maybe the other party has struggled to uphold their end of the bargain. In these situations, I can help negotiate an off ramp--whether that's an early termination, buyout, settlement, or something else.

In addition to negotiating an out, I can assess the potential claims, defenses, and chances of success if litigation ensues. This analysis allows clients to make informed decisions about whether the costs/risks of litigation are worthwhile.

At the end of the day, this consultative work is about mitigating risks and making smart business decisions. It allows me to leverage my litigation skills in an advisory role before getting anywhere near a courtroom. And, if the off ramp doesn't work, I'm right there, ready and able to pursue your case or defend against one.
